Outcome: The accused pleaded guilty to one rolled up charge pursuant to sections 21(1) and 21(2)(a) of the Occupational Health and Safety Act 2004 in that it failed to provide a safe system of work and it failed to ensure a safe work method statement for high risk construction work was completed in compliance with the Occupational Health and Safety Regulations 2007. The accused provides domestic plumbing services including installation of roofing, fascia and gutters to new homes.

On 3 October 2014 a WorkSafe Inspector attended a single residential dwelling being constructed at Buninyong. The Inspector observed two Ballarat Plumbing Pty Ltd employees working on the roof of the domestic dwelling under construction, at a height of approximately 3.2 metres, with no fall protection in place. No safe work method statement for the work had been completed. On 27 July 2015 the accused was fined $3,000 without conviction and ordered to pay costs of $2,395. (Ballarat Magistrates Court).
