Outcome: Paul Andrew Van Krieken (‘Van Krieken’) pleaded guilty to a single charge pursuant to section 24(1) of the Occupational Health and Safety Act 2004 for failing to ensure, so far as is reasonably practicable, that persons were not exposed to risks to their health or safety arising from the conduct of his undertaking.
On 1 November 2014, Van Krieken arrived at a properly where he inflated a giant slide in a paddock in preparation for a child’s birthday party. Later that day, whilst children were playing on or near the giant inflatable slide, a gust of wind pulled the slide from its anchorage points and flipped it over. Several children were injured in the incident. Investigations revealed that the slide had not been sufficiently anchored to the ground.
On 16 July 2015, Van Krieken was without conviction, sentenced to pay a fine of $10,000.00 with costs in the sum of $3,372.00 (Geelong Magistrate’s Court).
